APPLICANT REQUESTS THAT:

His Total Federal Commissioned Service Date (TFCSD) be changed 
to 15 May 10.

APPLICANT CONTENDS THAT:

He was commissioned on 15 May 10, but after a medical condition 
prevented him from being a pilot, he was incorrectly told he had 
to be re-commissioned.  He was commissioned again on 15 Sep 10 
as a maintenance officer.  His TFCSD in his records was 
incorrectly changed from 15 May 10 to 15 Sep 10

STATEMENT OF FACTS:

According to the documentation submitted by the applicant, he 
was initially commissioned in the Air Force on 15 May 10.

On 15 Sep 10, the applicant was commissioned a second time.  

The remaining relevant facts pertaining to this application are 
described in the letter prepared by the Air Force office of 
primary responsibility (OPR) which is included at Exhibit C.

AIR FORCE EVALUATION:

AFPC/DPSIPV recommends the applicant’s request be granted.  The 
applicant was medically disqualified from attending flying or 
missile operations training due to color blindness.  He was told 
by his Air Force Reserve Officer Training Corps (ROTC) 
Detachment that his medical condition voided his commission.  
However, neither the AFROTC Registrar nor Detachment Commander 
have the authority to void the applicant’s commission, and being 
medically qualified to be a pilot was not a requirement of his 
commission.  Once he was commissioned on 15 May 10, he was a 
Reserve Air Force Officer and would have needed to be discharged 
as such.  AF/JAA previously provided legal counsel in such 
cases, opining that initial commissions are valid and remain in 
effect.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the 
applicant on 27 Jan 14 for review and comment within 30 days.  
As of this date, no response has been received by this office 
(Exhibit D).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by 
existing law or regulations.

2.  The application was timely filed.

3.  Sufficient relevant evidence has been presented to 
demonstrate the existence of an injustice.  We took notice of 
the applicant's complete submission in judging the merits of the 
case and agree with the opinion and recommendation of the Air 
Force office of primary responsibility and adopt its rationale 
as the basis for our conclusion that relief should be granted.  
Therefore, we recommend the applicant’s record be corrected as 
indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air 
Force relating to the APPLICANT be corrected by removing any and 
all documents related to his erroneous commissioning on 
15 September 2010.
